Bukkawaste is a wholly owned proprietary digital application used via a smart phone for waste collection (‘Bukka App’). Bukkawaste is a booking and payment application and will sub-contract to contractors the performance of all services to the customer.
The Customer agrees to pay Bukkawaste the charges due on the same day of collection via the push notification using the Bukka App.
Orders can be cancelled at any time, provided that the cancellation notice must be received by Bukkawaste no less than 24 hours’ prior to the data and time of the ordered service
Failure to pay all charges agreed may lead to withdrawal of the service
The contract formed and including these Terms of Service may be terminated by the Customer, at any time without cause. Bukkawaste also has the right to terminate its contract with the Customer or withdraw any services at any time, without cause, provided that each party notifies the other in writing. Termination takes effect from the date on which notice of termination is provided by either party, and does not affect any legal rights of either party which may have accrued prior to such notice.
The Customer shall provide a suitable and safe means of vehicular access for the servicing of the waste.
The Customer shall be wholly responsible for the safety of all persons (including the employees and agents of the contractor), entering within the curtilage of the customer's premises.
The Customer shall bear all risks involved in connection with siting, loading and use of the equipment, servicing of the waste at the Customer's premises and failure to comply with any of the Customer's obligations in these Terms of Service.
The Customer shall indemnify Bukkawaste from and against all proceedings and claims for any loss, damage, personal injury or loss of life arising from any of the Customer's undertakings and obligations under these Terms of Service, however caused, except where the Customer can affirmatively establish that the circumstances giving rise to the same, were solely attributable to the negligence or wilful act or default of Bukkawaste or any of its employees or agents.
Bukkawaste shall not be responsible for any property (including personal effects), deposited by the Customer or any other person in the waste or the equipment and shall not be bound to return the same, nor be liable for any loss or damage thereto.
Bukkawaste will endeavour (through its sub-contracted service providers) to service the waste as requested, unless delayed or prevented from doing so by circumstances beyond its reasonable control. Bukkawaste shall not be liable to the Customer or to any third party, for any direct or consequential loss or damage caused by any delays in the performance of its obligations.
A ‘missed collection’ is as described/definied in the Duty of Care. The term 'missed collection' does not include incidents where the Contractor cannot gain safe access to the refuse or where the collection has been re-scheduled.
Any missed collections must be reported using the push notification via the Bukka App within [12] hours of an alleged ‘missed collection’ event (‘Reporting Period’). Bukkawaste will not generally instruct its sub-contractor to return to empty any bins reported as missed outside of this Reporting Period, and no refunds will be issued if the report is not made within the Reporting Period.
Suspected missed collections should be reported to our Customer Services using the push notification via the Bukka App. Genuine missed bins will be collected as soon as possible after they are reported, generally within one working day, however, Bukkawaste is not obliged to arrange for its sub-contractor to return to empty a bin or collect sacks, which the sub-contractor has identified and recorded as:
A Customer will not be charged for any such attempted collections. A Customer will be charged for a return visit if the missed collection is the Customer’s fault. There will be no charge if the sub-contractor is in the area and is not classed as an emergency collection. The Customer will be required to rectify any waste compliance problem before a sub-contractor crew will collect waste, at the next scheduled collection date.
Contaminated recycling bins will not be emptied. The Customer will be notified of the issue via the Bukka App, with a photo where possible, and explanation why the collection has not taken place. This will come directly from the allocated sub-contractor who will be on site. The bin will not be collected until the contamination is removed. It is the responsibility of the Customer to sort the contents of the bin and remove contamination. No refunds will be issued in these circumstances.
By making an application to Bukkawaste to have domestic waste and / or recycling collected, the Customer agrees that on acceptance of the application, a binding contract will be formed and, the Customer understands and agrees that they are then obliged to pay all appropriate charges under the contract.
In making an application, the Customer is deemed to have read and accepted in full, these terms and conditions of the service (Terms of Service). Subject to any overriding statutory or legal right which may not be excluded by these Terms of Service, these Terms of Service apply and supersede all other written and verbal agreements, arrangements and representations made at any time between the parties and any conflicting terms or purchase or order sought to be imposed by the Customer. No other terms, conditions or warranties expressed or implied shall be of any effect whatsoever
Bins must be available from 7.00am on the day of collection, unless specific arrangements have been made.
No liquid waste must be put into the bin.
Only waste identified in the Duty of Care document may be placed in the bin. Equipment containing CFC (i.e. fridges/freezers) cannot be collected as part of the standard collection service.
Only waste/recycling contained within the bin(s) will be collected. No waste/recycling around the bin(s) or left on top will be collected.
Bin lids must be kept shut, to prevent refuse blowing out from the bins.
Any bin that is deemed to be overweight and is therefore, unsafe to handle or empty, will not be emptied by an assigned Bukkawaste sub-contractor. In such cases the contractor will not return to empty the bin and it shall be the responsibility of the Customer to ensure that the weight of the bin is reduced prior to the next scheduled empty.
Where any single item of waste is, in the contractor’s reasonable opinion, too large, heavy or dangerous to be placed in the collection vehicle without risk to the equipment, it will be not be collected.
Only those materials notified as recyclable (currently clean paper, cardboard), will be acceptable for recycling collection. If contaminated the contractor will notify you via the Bukka App.
All recyclable material must be placed loose in the bin and should not be compacted in any way.
Please note that if the recycling materials are heavily contaminated with other waste, the container will not be emptied.
These terms and conditions were updated on 1st June 2017 and apply immediately to any Customer who applies for the service from that date.
Bukkwaste will not debit your transaction at time of booking. You have up to 72 hours to amend your collection free of charge. Payments are only processed within 24 hours prior to your collection. If you have booked a collection and not amended up until 24 hours we will debit your payment via our secure payment provider, Worldpay. Bukkawaste don't hold any personal or financial information as Worldpay act as our preferred payment merchant.
